General Election 11/3/2026

Effective January 1, 2024, and pursuant to 15 Del. C. § 3002, § 3106, § 3301, § 3402 and § 7103, all candidates for statewide office, the General Assembly, and any elected County office must request a criminal history background check from the State Bureau of Identification ("SBI") no later than the filing deadline. Delaware law does not require background checks for candidates for federal office and City of Wilmington office.

Provisional Status = Filed candidate for statewide, General Assembly, or elected County office has scheduled a criminal history background check from the State Bureau of Identification (“SBI”), and the State Election Commissioner is awaiting the results of the criminal background check in order to determine the candidate qualifies for candidacy pursuant to Section 21, Article II of the Delaware Constitution.

Qualified Status =
(1) State Election Commissioner has received and reviewed the criminal history background check results of the candidate who filed for statewide, General Assembly, or elected County office, and has determined the candidate qualifies for candidacy pursuant to Section 21, Article II of the Delaware Constitution, OR
(2) Candidate filed for a federal or City of Wilmington office, offices for which background checks are not required by Delaware law.
