Automatic Voter Registration at Delaware Division of Motor Vehicles

What is Automatic Voter Registration?
  • Pursuant to Delaware law (15 Del. C. § 2050A), every person who:
    • completes an in–person or online application for the issuance or renewal of their Delaware Driver's License, Learner's Permit, or State Identification Card or completes an in–person or online application to change their name or address on these documents, and
    • is not already registered to vote, is of sufficient age, and whose citizenship status has been confirmed by the Division of Motor Vehicles is automatically registered to vote by the Department of Elections.
  • IMPORTANT NOTICE TO AVR VOTERS: If you were automatically registered to vote at DMV through the Automatic Voter Registration (AVR) process, you were automatically registered without a party affiliation. Voters who were automatically registered at DMV ("AVR Voters") have a different party change deadline than other registered voters. AVR voters may change their party from "No Party – AVR" by submitting a voter registration application to change their party through the day of the first primary election following their automatic voter registration at DMV in order to vote in that primary election. AVR voters who do not choose a party by that first primary election after AVR will be registered as "No Party" voters and then eligible to change their party affiliation during the standard party change periods designated in the Delaware Code.
What happens when a person is automatically registered to vote at DMV?
  • Voters who are automatically registered to vote at the DMV ("AVR Voters") are automatically registered with "No Party" affiliation (i.e., not affiliated with any party) and are registered as of the date of their DMV transaction.
  • Immediately following a person's automatic voter registration, the Department of Elections will mail a NOTICE OF AUTOMATIC VOTER REGISTRATION, which includes a RESPONSE TO AUTOMATIC VOTER REGISTRATION form.
What is the purpose of the NOTICE OF AUTOMATIC VOTER REGISTRATION?
  • The purpose of the Notice is to:
    1. Inform AVR Voters that, as of their DMV Transaction Date, they are registered to vote in Delaware as an unaffiliated ("No Party") voter;
    2. Provide AVR Voters the opportunity to choose a party affiliation if they wish;
    3. Provide AVR Voters the opportunity to review their eligibility to register and cancel their registration if they are ineligible or do not want to be registered to vote at this time; and
    4. Advise AVR Voters of Delaware's Address Confidentiality Programs, outlined in 15 Del. C. § 1303 and 11 Del. C. § 9613.
How can automatically registered voters cancel their voter registration?
  • AVR Voters may complete and submit to the Department the Response to Automatic Voter Registration form included in the Notice mailing to cancel their registration/unregister to vote.
  • AVR Voters may complete an online form and submit it at https://ivote.de.gov to cancel their voter registration/unregister to vote.
How can automatically registered voters change their party from unaffiliated ("No Party") status?
What if I receive a Notice from the Department in the mail for a person who does not live at my address?
  • Write "Not at this address" in an open area of the envelope.
  • Place the mail piece in a mail collection box (mailbox), take it to the Post Office, or hand it to your postal carrier.
  • The United States Postal Service (USPS) will return the mail piece to the Department, and the Department will start the address verification voter removal process in accordance with the National Voter Registration Act (NVRA).
